The terms, policies and agreements that cover Mokanata, in plain words wherever the law allows.

The agreement between your organisation and Mokanata for using the website, the dashboard, the API and the agents. The other documents on this page are part of it.

1. The agreement#

These Terms and Conditions ("Terms") govern your use of Mokanata: the website at mokanata.com, the dashboard at app.mokanata.com, the API, the MCP server, the website chat widget and the AI agents that run inside them (together, the "Service"). The Service is provided by Mokanata ("we", "us").

By creating an account, joining a workspace or using the Service, you agree to these Terms. If you use the Service for an organisation, you agree on its behalf and confirm you have the authority to do so; "you" then means that organisation. You must be at least 18 years old.

The following documents are part of these Terms: the Privacy Policy, the Refund Policy, the Acceptable Use Policy, the AI Policy, the Cookie Policy, the Data Processing Agreement and, on Pay as you go, the Service Level Agreement.

2. Words we use#

  • Workspace. The space your team shares in Mokanata, with its own members, channels, agents, data and bill.
  • Customer Data. Everything you or your contacts put into the Service: messages, contacts, deals, files, knowledge sources, forms and their responses, and records synced from your own database.
  • Agent. An AI agent you deploy in a workspace, at the Shadow, Approval or Autonomous level.
  • Agent action. One unit of work an agent completes, as defined on the pricing page. It is what Pay as you go bills.
  • Connected service. A channel, payment gateway, ad platform, model provider, database or app you connect to Mokanata.

3. Accounts and workspaces#

Give accurate account details and keep them current. Keep your devices, passkeys, authenticator app, recovery codes and API keys secure. You are responsible for everything done under your account and by the members you invite, within the roles you give them. Tell us at support@mokanata.com straight away if you think someone has used your account without permission.

A workspace's owner controls it: its plan, members, roles and data. Ownership can be transferred from the workspace settings.

4. Plans, billing and taxes#

  • Free costs nothing. Agents run on your own machine, history and data are kept for 7 days, and support comes from the community.
  • Pay as you go bills $0.01 per agent action, in US dollars, in arrears, once a month. People, channels, contacts and agents are not charged for. History is kept for 1 year.

Prices exclude taxes. Where the law requires us to collect VAT or a similar tax, we add it to the invoice. You authorise us to charge the payment method on file when each invoice is issued. If a payment fails, we will tell you and try again. If it is still unpaid 14 days after we tell you, we may move the workspace to Free or suspend it until it is paid.

Credits from promo codes and referrals reduce future invoices. They have no cash value, cannot be transferred and expire on the date shown with them (referral credit lasts 12 months).

Connected services bill you directly and are not part of the Mokanata invoice: for example Meta's WhatsApp conversation charges, your own model provider's charges when you bring your own key, and payment gateway fees.

We may change prices with at least 30 days' notice by email and in the dashboard. A change applies from the next billing period after the notice ends. Refunds are covered by the Refund Policy.

5. Your data#

You own your Customer Data. You give us the right to host, copy, process, transmit and display it only as needed to provide, secure and support the Service for you, and as described in the Data Processing Agreement.

We do not sell Customer Data, and we do not use it to train models for other customers. You can export contacts, deals and conversation history at any time.

You are responsible for having the right to put Customer Data into the Service, and for the notices and consents your contacts need, including before you message them.

6. AI agents and what they send#

Agents draft, and depending on the autonomy level and rules you set, send messages and change records for you. You choose each agent's level, guardrails, auto-approve rules and knowledge sources. Messages and changes an agent makes in your workspace are made on your behalf, and you are responsible for them as if your team had made them.

AI output can be wrong, incomplete or out of date. Review drafts where accuracy matters, and use the approval queue for anything you would not want sent unchecked. The AI Policy has the details.

7. Connected services#

The Service works with services we do not control, such as WhatsApp, Instagram, Facebook, Telegram, TikTok, LinkedIn, X, Threads, email providers, payment gateways, ad platforms and model providers. When you connect one, you agree to its terms and policies (for example the WhatsApp Business and Commerce policies), and its provider is responsible for it. We are not liable for a connected service's availability, changes, fees or decisions, such as a provider limiting or banning your account.

8. Payments you collect#

You can send your customers payment links and QRIS codes through your own payment gateways. Mokanata is not the merchant, a party to the sale or a payment provider. The agreement, the money, refunds and disputes are between you, your customer and your gateway.

9. Acceptable use#

Use the Service lawfully and as the Acceptable Use Policy describes. Don't attempt to break, overload or get around the Service's limits or security, copy or resell it without our written agreement, or reverse engineer it except where the law allows.

10. Availability and support#

We work to keep the Service running and secure, and we change it over time: features may be added, changed or retired. If we retire a feature you pay for, we will give you reasonable notice. Free is supported by the community. Pay as you go includes customer support, a dedicated success manager and the uptime commitment in the Service Level Agreement. Features marked beta or preview are provided as they are and may change or stop.

11. Confidentiality#

Each of us keeps the other's non-public information confidential, uses it only for this agreement, and shares it only with people who need it and are bound to keep it confidential. This does not cover information that is public through no fault of the receiver, was already known to it, or is independently developed. Either of us may disclose information when the law requires, after notifying the other where the law allows.

12. Our property and your feedback#

We own the Service, including its software, design, documentation and brand. These Terms give you the right to use it while your workspace is active; they don't transfer ownership. If you send us suggestions, we may use them without owing you anything.

13. Ending the agreement#

You can stop at any time: move to Free, or delete the workspace or your account from the settings. Pay as you go actions taken before then are billed on the final invoice.

We may suspend or end your access if you materially breach these Terms and don't fix it within 14 days of our notice, if an invoice stays unpaid as described above, or straight away if your use puts the Service, other customers or the public at risk, or if the law requires it. Where we can, we will tell you first and explain why.

When a workspace ends, you have 30 days to export your data, unless the law prevents it. After that we delete it as the Privacy Policy describes. Sections that by their nature should survive (such as payment owed, confidentiality, ownership, disclaimers, liability and governing law) survive.

14. Disclaimers#

Except as these Terms expressly say, the Service is provided "as is" and "as available". To the extent the law allows, we disclaim all other warranties, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise that the Service or any agent output will be uninterrupted, error-free or accurate.

15. Limits on liability#

To the extent the law allows:

  • Neither of us is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, goodwill or data, even if warned they might happen.
  • Each party's total liability under this agreement is limited to the greater of the amounts you paid us in the 12 months before the claim and US$100.

These limits don't apply to your payment obligations, to either party's breach of confidentiality, to your obligations under section 16, or to liability that cannot be limited by law, such as for fraud.

16. Your responsibility to us#

You will defend and compensate us against third-party claims that arise from your Customer Data, from the messages and actions sent from your workspace, or from your breach of these Terms or the Acceptable Use Policy, provided we tell you promptly, let you control the defence and cooperate reasonably.

17. Changes to these Terms#

We may update these Terms. For a material change, we give at least 30 days' notice by email and in the dashboard before it takes effect. Smaller changes, such as clearer wording, take effect when published. The date at the top of this page shows when the text last changed. If you keep using the Service after a change takes effect, the new Terms apply; if you don't agree, stop using the Service and export your data.

18. Governing law#

These Terms are governed by the laws of the Republic of Indonesia. We will try to resolve any dispute informally first: write to support@mokanata.com and give us 30 days. If that fails, the courts of Jakarta, Indonesia have exclusive jurisdiction. Nothing here limits the rights you have under the consumer law of where you live.

19. General#

These Terms are the whole agreement between us about the Service and replace earlier ones on the same subject. If a provision is unenforceable, the rest stay in effect. Not enforcing a right is not a waiver of it. You may not assign this agreement without our consent; we may assign it to a successor in a merger or sale of the business. Neither of us is liable for delays caused by events beyond reasonable control. We send notices to the workspace owner's email address; you send them to support@mokanata.com.
